We would like to make you aware that New Castle County, DE has implemented new ordinances with a July 11, 2023, effective date. These ordinances are Façade Inspections of Covered Buildings and Primary Load Bearing System Inspections and required according to ordinance No. 23-094.

PLBS Inspection Criteria:

  • 2 years from the effective date of this ordinance; or
  • 60 days after observation damage to the PLBS,
  • If the Design Professional determines that unsafe and imminently dangerous conditions exist such that the observable damage compromises the structural integrity of the PLBS, immediate action is required. When such conditions are discovered, remedial steps to avoid harm to people or property shall be taken as required under section PM 109.

Façade Inspection Criteria:

  • 5 years of the date on which the covered building was issued a certificate of occupancy;
  • 60 days after observable damage to the façade.
  • If a covered building was issued a certificate of occupancy prior to the effective date of this Section, then an initial façade inspection shall be undertaken by a design professional within 2 years of the effective date of this Section.

Subsequent Inspections period of time will be determined by the Design Professional if corrective maintenance is required following this inspection.

PLBS INSPECTION REPORT
Falcon will perform the following services to comply with the County Ordinance:


A. Review any documents pertinent to the evaluation as made available to us, this includes existing plans, engineering and testing reports, and construction, repair or maintenance projects completed to date.
B. Falcon will perform visual inspections of all elevations in accordance with the ordinance guidelines. The visual inspections will be conducted via binoculars, photographic magnification techniques from terraces/balconies, accessible windows, roofs and street level.
C. Falcon will conduct up-close inspections via access provided by the owner.
D. Obtain representative photographic documentation of the specific deficient conditions to be included in the report.
E. Provide a written
report, to the Owner, in compliance with the County Ordinance requirements. Statements regarding the probable cause of deteriorated conditions will be included along with a schedule of required maintenance.
        a. Report will include a statement on the classification of the building in accordance with the façade ordinance. It will also include a location for the building Owner or Agent to sign acknowledging receipt of the report and recommended maintenance schedule.
         b. After the Owner has reviewed and signed the report, the report will be submitted to the County’s Office of the Recorder of Deeds.
