What Local Law 126 Requires for NYC Parking Structures

Taking effect on January 1, 2022, Local Law 126 establishes the Periodic Inspection of Parking Structures program, which applies to various garage types across all five boroughs. The legislation responds to concerns about aging parking infrastructure and the need for systematic monitoring of structural conditions.

The law covers these parking structure types:

  • Open and enclosed parking garages as defined by the NYC Building Code
  • Buildings or portions of buildings dedicated to vehicle parking or storage
  • Parking spaces located inside or beneath residential and commercial structures
  • Municipal, state-owned, commercial and residential parking facilities

Certain structures remain exempt from Local Law 126 requirements, including automotive repair shops, automotive showrooms, service stations, garages accommodating fewer than three vehicles, unenclosed outdoor parking lots and private garages serving one- and two-family homes.

Inspection Cycles and Compliance Deadlines Under Local Law 126

The Department of Buildings divides inspection requirements into geographic subcycles by community district. Manhattan Community Districts 1 through 7 completed inspections during the first cycle from January 2022 through December 2023. Manhattan Community Districts 8 through 12 and all Brooklyn structures followed during the second cycle, spanning January 2024 through December 2025.

The current third sub-cycle covers the Bronx, Queens and Staten Island, with inspections required between January 1, 2026, and December 31, 2027. Property owners must engage Qualified Parking Structure Inspectors who hold New York State Professional Engineer licenses and possess at least three years of parking structure experience.

Inspectors classify garages into three condition categories:

  • Safe: Minimal deterioration, with the next report due in six years
  • Safe with Repair and Engineering Monitoring: Conditions requiring attention before the next cycle
  • Unsafe: Immediate dangers necessitating protective measures and 90-day repair completion

Building owners must file inspection reports within 60 days of the completion of each examination. Structures classified as Unsafe require immediate safeguarding actions and amended reports within two weeks of completing repairs.

Why Local Law 126 Compliance Matters for Property Owners

Parking structure failures can result in devastating consequences, including collapsed decks, falling concrete and compromised structural support systems. Regular inspections detect early warning signs, such as concrete spalling, rebar corrosion, slab cracking and inadequate drainage, that contribute to accelerated deterioration.

Noncompliance triggers significant penalties. The Department of Buildings issues violations for late filings, missing inspections and failure to address unsafe conditions within required time frames. These violations appear in public records that affect property values, insurance coverage availability and financing options.
