Did you know that the NJDEP enacted major regulatory updates in 2023 and 2026 to protect rivers, lakes, and the ocean from non-point source pollution? These regulations (found in the New Jersey Administrative Code, N.J.A.C. 7:8) require municipalities to create enforcement programs to ensure that private stormwater facilities; including, but not limited to, detention basins, wet ponds, and dry wells are operating properly and being properly maintained.

The New Jersey Department of Environmental Protection now requires municipalities to ensure that private stormwater facilities (including those within your community) are regularly maintained, inspected, and certified by a qualified inspector. Documentation of these inspections must be included in annual reporting to the NJDEP.

Many local municipalities have adopted new ordinances establishing maintenance and reporting obligations for private property owners.

Failure to comply with these requirements may result in municipal notices of violation or fines. Don’t get caught off guard without the proper inspection and certification of your stormwater facility.
