This is a critical reminder for building owners regarding compliance with Local Law 97 (LL97).

If you plan to apply for an extension to submit your LL97 Compliance Reports, you must hire a registered design professional (RDP) or retro-commissioning agent (RCx agent for Article 321 buildings) by February 1, 2025.

Here are the key dates and penalties to keep in mind:

  1. Compliance Reports Due Date: All LL97 compliance reports must be filed by May 1, 2025.
  2. Grace Period: A 60-day grace period is allowed, with the final filing deadline being June 30, 2025.
  3. Penalties: Article 320 buildings required to submit an annual emissions report will incur penalties for late filings:
  • Failure to file by June 30 results in a monthly penalty of $0.50 per square foot of the building.
  • For example, a 25,000-square-foot building will face a $12,500 monthly penalty starting July 1, 2025. At the close of the grace period, this penalty will already total $25,000.

Extension to August 29, 2025: Building owners can apply for an extension to the reporting deadline if the RDP (for Article 320 buildings) or RCx agent (for Article 321 buildings) cannot complete the report by June 30. To qualify, the following must be submitted:

  1. A contract between the owner and the RDP or RCx agent, executed no later than February 1, 2025.
  2. An affidavit signed by both the owner and the RDP or RCx agent, stating:
  • The professional could not complete the report on time.
  • The report will be completed and filed within 120 days of the May 1, 2025 deadline.
